NC-Politics.Com - General policies and
service guidelines
The following general
guidelines were designed to insure our services are delivered in a timely and
efficient manner to all customers. The Specific
terms of service are also shown below this notice, please read both carefully.
Website Linkage:
NC-Politics.com provides, as a no-charge service, the linkage (hosting of links) of
candidate campaign
websites within the pages of the NC-Politics.com "political portal".
NC-Politics.com provides, as
a public service, linkage (hosting
of links) to
"official" government websites representing, cities, counties, states,
government agencies, and / or branches of government. Such links may
include information about a current candidate in their "official"
elected capacity. These linkages are not subject
to a fee schedule (i.e.,
"free"). NC-Politics.com reserves the right to include / exclude any
such site(s) at it's sole discretion.
Content:
NC-Politics.com services may be used for
lawful purposes only. Transmission,
storage, or presentation of any information, data or material in violation of
any United States Federal, State or City law is prohibited.
This includes, but is not limited to: copyrighted material, material we
judge to be threatening, obscene, demeaning to others, or material protected by
trade secret and other statute. The customer agrees to indemnify and hold us
harmless from any claims resulting from the use of the service which damages the
customer, other customers, or any other party.
NC-Politics.com customer sites are
not allowed to knowingly violate any Federal or State election laws or statutes.
Customers are ultimately responsible for familiarizing themselves with
such laws and statutes and avoiding violation.
Gambling, Pornography and
sex-related merchandising are prohibited on our servers, and we do not allow
linkage to such sites. This includes sites
that may infer sexual content, or link to adult content elsewhere. This is also
true for sites that promote any illegal activity or content that may be damaging
to our customers, servers, or any other server on the internet. Links to such materials are
also prohibited.
In addition any site selling
or promoting Bulk email services is not allowed
Commercial Advertising -
Email:
Our servers may not be the source, intermediary, or destination address involved
in the transmission of spam, flames, or mail bombs. Your domain may not be
referenced as originator, intermediary, or reply-to address in any of the above.
Advertising sites on other servers which in turn contain links to a domain on
our servers is prohibited. We consider spam any mass unsolicited message in the
mediums of Newsgroups and Email. If you are found to have spammed, then we will
immediately, without warning, disable your domain.
We reserve the right to refuse or cancel service to known spammers.
Lastly, we reserve the right to determine what violates this policy.
As such, any violation will
result in immediate deactivation of services without refund.
Server
Abuse:
Any attempts to undermine or cause harm to a server (or any other customer site)
is strictly prohibited. We reserve
the right to refuse or cancel service to any individual associated with any
sabotage attempt or act (past, present, future). Additionally, we reserve the right to determine what violates
this policy.
As such, any violation will
result in immediate deactivation of services without refund, and such acts will
be reported to law enforcement agencies. .
Refusal of Service:
We reserve the right to refuse or cancel service at our sole discretion.
Service Exceptions :
Some specific services are limited and/or prohibited on our servers
Examples of non-acceptable content or links:
- Pirated software
- Hackers programs or archives
- Warez Sites
- Irc Bots
- Mp3 if being illegally distributed
CGI Scripts
Each hosting customer account comes with its own cgi-bin. Customers are free to use any
ncpolitics provided CGI scripts, customer provided CGI-scripts are highly
discouraged, we reserve the right
approve / deny or to disable any CGI script that effects normal server operation
without prior warning.
Chat Rooms
We do not allow customers to install their own chat rooms. These tend to be
large system hogs and we cannot allow it as an account option.
Background Running
Programs
Background daemons in general are prohibited, we will consider requests on a one
on one basis. If allowed extra charges will be assessed based on resources on
system maintenance needed.
IRC
We currently do not allow IRC or IRC bots to be operated on our servers.
ncpolitics will be the sole
arbiter as to what constitutes a violation of this provision.
If any terms or
conditions are failed to be followed it may result in account deactivation.

Specific
and Detailed - Terms of Service
This AGREEMENT
between Network Presence Communications Corp. (hereinafter referred to as "NC-Politics.com") and Account
Holder (hereinafter referred to as "Customer") WHEREAS NC-Politics.com provides the service including but not limited to that of Website linkage, Web Hosting, Domain
Name Registration Service, E-mail Service, and File Upload Service (the
"Service"); AND WHEREAS Customer desires to subscribe to the Service
on the terms and conditions contained herein; now THEREFORE in consideration of
the mutual agreements contained in this Agreement, ncpolitics and Customer agree
as follows:
Detailed Terms of Service
1. The
Service
NC-Politics.Com's
services include but are not limited to the following: Website Construction, Template Site setup,
Domain hosting, POP and web-based e-mail, Candidate profile hosting, link hosting, and file upload (FTP). NC-Politics.com does
not place banners on Customers' web sites although Customers may choose to do so
in accordance with all regulations set out by NC-Politics.com, the province, and the
country. NC-Politics.com or its affiliate NC-Candidate.com may charge a Customer for: Website Establishment & linkage / Website and/or Template sale and site setup, and
monthly maintenance fee for the aforementioned services (in conjunction with NC-Candidate.com) unless Customer chooses
to use optional services that are subject to a fee. Candidate Profile and Forum listing are "no-charge" items.
Customer is, however,entirely responsible for:
i. All fees
and/or charges related to domain name registration and/or renewal;
ii. Presenting
available payment upon due date for any of NC-Politics.Com's paid services; (if any), if
account(s) has outstanding balance, NC-Politics.com reserves the right to suspend all
services associated to Customer until amount is paid in full*
* Reactivation
service charges ($25) will apply for accounts suspended due to account
outstanding balance problems
iii. Providing
all necessary equipment and software to establish a connection to the World Wide
Web and use the services offered by ncpolitics, including but not limited to a
computer and modem;
iv. Providing
own access to the World Wide Web and pay for all fees associated with such
access, (your own ISP).
2. Customer
Information
To be able to
use the Service, Customer must complete a proper registration process. Customer
agrees to:
i. Provide
current, complete and accurate personal information (referred to as the
Registration Data) as requested by the Service;
ii. Maintain
and update this information to keep it current, complete, and accurate.
NC-Politics.Com does
not sell or disclose any Registration Data to a third-party unless:
i. Customer
voluntarily discloses such information to another party;
ii. Customer
expressly directs ncpolitics to release such information;
iii. NC-Politics.Com
is required to disclose such information by any applicable law or legal process
served on NC-Politics.com.
3.
Advertisements
Customer may
choose to display advertising banners on own web site, provided that the
advertisements are not of illegal, pornographic, or discriminatory nature.
Customer may also enter into correspondence with or participate in
promotions of the Advertisers whose banners are displayed on own or other
Customers' web sites. Any such correspondence or participation, including the
payment and delivery of products and services, and any other terms, conditions,
warranties or representations associated with such correspondence or
participation, are solely between the corresponding Customer and the Advertiser.
ncpolitics assumes no liability, obligation or responsibility for any part of any
such correspondence or participation. Customer assumes the
responsibility for site maintenance of any site where advertisement has been
placed on the site.
4.
Limitations
The Service is
subject to the following limitations:
i. Customer
agrees not to engage in any activity that could overwhelm the server with heavy
CPU usage or that requires a disproportionate or unreasonable amount of the
resources of the ncpolitics server;
ii. Customer
shall not include content or Internet links to content on the Site that may
contain, promote, or involve the following:
a. any
infringement of copyright, trademark, patent, trade secret or other intellectual
property right;
b. nudity or
pornography;
c. content that
exploits children under 18 years of age;
d. hate
propaganda;
e. racist,
threatening, or otherwise abusive content;
f. content
promoted through the sending of unsolicited e-mail (also known as spamming);
g. sending of
unsolicited e-mail (spam) from the NC-Politics server, or any other server that
refers to content on the NC-Politics server, or sending such e-mail with a
ncpolitics-hosted web site listed as the contact address;
h. mail fraud,
multilevel marketing (pyramid) schemes or other fraudulent activities;
i. the
promotion or incitement of, or instruction for, the commission of illegal
activities;
j. information
or other material that contains a virus, corrupted data or other harmful or
damaging component.
5. Customer
Account, Password, and Security
A password and
an account are provided to Customer upon completion of registration. Customer is
entirely responsible for
i. maintaining
confidentiality of the password and account;
ii. All
consequences of voluntary disclosure of password and account information;
iii. Any and
all activities that occur under Customer's account.
Customer agrees
to notify NC-Politics immediately of any unauthorized use of Customer's account or
any other breach of security known to Customer.
6.
Cancellation
Notice is
required to cancel your linkage service with NC-Politics but there is no cancellation fee.
Cancellation notice must be given prior to the period end and take effect on the
period end only, there is no pro-rating of fees paid for service between notice
date and period end. All yearly and period linkage fees paid for service up to the notice of
cancellation, after the 15-day trial, period are nonrefundable. Promotional offers
bundled with hosting services are subject to payment if cancellation occurs
within the first 15 days of services.

required to cancel your service with NC-Candidate.com . Please see
NC-Candidate.com hosting terms and conditions.
7. Data
transfer and web space limitations
In order to
load balance our servers keeping our services cost effective for our paying
Customers, bandwidth limitations and web space is limited to a maximum of 500 MB
of data transfer monthly and 30MB of web space depending on Customers account
type. Customer agrees to pay any
bandwidth and or web space overages that may occur on their account. Bandwidth
overage charge is $2.00/1GB/mo. Web space overage charge is $2.00/50MB/mo.
8.
Amendments to Agreement
Customer agrees
to be bound by any amendments or modifications to this Agreement that are set
out, from time to time, by NC-Politics anywhere on this site http://www.NC-Politics.com/.
9.
Modifications to Service
NC-Politics.com
reserves all rights to modify or discontinue the Service with or without notice
to Customer. ncpolitics shall not be liable to Customer or any third party should
NC-Politics exercise its right to modify or discontinue the Service.
10. No
Representations or Warranties
The Service
offered by NC-Politics.com is on an "as is" basis, with no representations
or warranties of any kind, expressed or implied. For greater certainty and
without limitation to the generality of the following:
i. NC-Politics.com
makes no representations, warranties or guarantees of any kind, whether written
or verbal, regarding the reliability of the Site provided or any other services
offered;
ii. NC-Politics.com
is not responsible for deleted, altered, or lost data due to network or system
outrages, file corruption, accidental deletion, or any other reasons;
iii. NC-Politics.com
makes no representations, warranties, or guarantees with regards to server
reliability, speed or consistency;
iv. NC-Politics.com
makes no representations, warranties or guarantees as to the accuracy or
correctness of any content on any of the Sites and is not responsible for any
errors or omissions arising from the use of such information;
v. NC-Politics.com
may also include, within its web resources , products/services, or in
newsletters, information, templates, software provided by 3rd party partners and
providers. NC-Politics.com does not guarantee or warrant the reliability of this
information nor does NC-Politics.com recommend any of these services.
11.
Limitation of Liability
NC-Politics.com is
not responsible for any failures, delays, or interruptions in the delivery of
any content or services contained on the NC-Politics server; or losses or damages
arising from the use of the content or services provided by NC-Politics.com. For
greater certainty and without limitation to the generality of the following:
i. in no event
will ncpolitics be liable to Customer for any direct, indirect, incidental or
consequential damages arising out of the Service or in connection with the Site
or any other services or products provided to Customer;
ii. NC-Politics.com,
and it's employees shall in no way be liable to Customer or anyone else for any
loss or injury resulting from use of the Service or the Site;
iii. In no
event shall NC-Politics.com be held liable for any damages, whatsoever, as a result of
notifying any official of potentially illegal content on the Site, providing
copies of Customers' web pages to the appropriate officials or cooperating with
law enforcement efforts to locate persons who have posted content that is
illegal or promotes illegal conduct.
12.
Indemnity
Customer agrees
to indemnify and hold NC-Politics.com harmless from and against, and to reimburse
NC-Politics.com with respect to, any and all losses, damages, liabilities, claims,
judgments, settlements, fines, costs and expenses (including reasonable related
expenses, legal fees, costs of investigation) of every nature whatsoever
incurred by ncpolitics by reason of or arising out of or in connection with
i. any breach
of this Agreement by Customer;
ii. Any
infringement of any copyright, trademark, patent, trade secret or any other
intellectual propriety right of any party by content on the Site;
iii. Illegal,
pornographic, or discriminatory content on the Site
13.
Termination
Customer agrees
that NC-Politics.com may terminate this Agreement, discontinue it's Services (links) and delete
any established web site at any time with or without notice to Customer in any of the following
circumstances:
i. Customer
violates any term of this Agreement, any municipal, provincial or federal laws,
or any policy set out, from time to time, by NC-Politics.com anywhere on this site
http://www.nc-politics.com/;
ii. Customer
engages in conduct or posts material on the Site that NC-Politics.com believes is
harmful to other Customers, the business of NC-Politics.com or any third-party;
iii. Customer
engages in any activity that could overwhelm the server with heavy CPU usage or
that requires a disproportionate amount of the resources of the NC-Politics.com
server;
iv. Customer
disputes the terms of this Agreement or any amendment set out by NC-Politics.com;
v. NC-Politics.com
receives complaints regarding Customer or the Site, from other Customers or
third-parties.
vi. Customer
provides personal information that is not current, accurate, and complete.
14.
Governing Law
i. This
Agreement is governed by and construed in accordance with the applicable laws of
the State of North Carolina and the federal laws of USA;
ii. Customer
and ncpolitics agree to submit to the exclusive jurisdiction of the courts of the
State of North Carolina and of USA;
iii. If any
provision of this Agreement is held to be invalid, illegal or unenforceable, all
other provisions will nevertheless continue in full force and effect;
iv. NC-Politics.com's
failure to exercise or enforce any right or provision of this Agreement shall
not constitute a waiver of such right or provision unless acknowledged and
agreed to by NC-Politics.com by writing;
v. Customer and
NC-Politics.com agree that any cause of action arising out of or related to this
Service must commence within one (1) year after the cause of action arose;
otherwise, such cause of action is permanently barred.
The section
titles in this Agreement are solely used for the convenience of the parties
involved and hold no legal or contractual significance.
15.
Disclaimer
i. The views
and opinions expressed by NC-Politics.com customers (within and outside of
their website) in NO way is intended to reflect the views of NC-Politics.com, its
management, affiliates, or employees ; Please direct complaints of
this nature to the source of the information.
ii.
Viewers agree that the use of our service is participatory and voluntary,
and further agree that should they have objection to any material obtained by
this method, their sole recourse (with ncpolitics) shall be to voluntary
discontinue participation & use of the ncpolitics site.
iii,
In no event
will NC-Politics.com be liable to Viewers for any direct, indirect, incidental or
consequential damages arising out of the Service or in connection with the Site
or any other services or products provided to Viewer
